U.S. Cities Are Beginning To Ban Pre-Employment Drug Testing For Cannabis

Great News For Those Who Are Using Full-spectrum CBD Products!

One big difference between getting a job in the United States and in Europe is drug testing. I remember when I started at my first job at a grocery store in the US at just 16 years of age I had to undergo pre-employment drug testing. Now that I’ve been living here for 5 years, it does sound ridiculous. When I tell my friends here in Germany about this, they are usually surprised.

Pre-employment drug testing is standard procedure in the United States. Many U.S.-based employers perform pre-employment or random drug testing. However, the U.S. attitude toward drug testing does not translate well with other countries. In Germany, there are laws protecting employee privacy. It’s the same for most other European countries as well; Employee data protection already applies before the employee has been taken on. That means data protection has to be observed before the employment relationship has been established, e.g. during the pre-employment screening process.

Pre-Employment Drug Testing In Europe Vs. United States

Unlike the U.S. the right for an employer to ask personal questions during an interview is also subject to the employee data protection regulations. In the United States, if you have committed a felony, an employer has every right to research into your background and deny you a job based on your past. In Germany, your privacy is protected and employers typically do not perform criminal background checks or pre-employment drug tests.

In many other countries, it is assumed that employers have a disproportionate share of the power and leverage in the employment relationship. That means employees have the right to be provided with certain legal protections that we don’t have in the U.S.

What does this mean for CBD users?

Although full-spectrum CBD oil has less than .2% THC., if you use it on a regular basis, over time it is more likely for you to fail a drug test. This is the reason why many opt for CBD crystals or other products that contain 0% THC.

This is great news for the hemp & cannabis users because no longer will those who are required to do drug testing be restricted to only using CBD isolate. Here’s a lost of the various cities in the US that are shifting away from policies requiring cannabis testing for employees:

  • Rochester, NY
  • Richmond, Virginia
  • New York City
  • Washington, DC
  • States: Maine & Nevada

NORML’s Deputy Director Paul Armentano said: “Suspicionless marijuana testing in the workplace is a holdover from the zeitgeist of the 1980s war on drugs. But times have changed; attitudes have changed, and in many places, the marijuana laws have changed. It is time for workplace policies to adapt to this new reality.”
