The Legal Landscape of CBD in Chile

Understanding the legal status of Cannabidiol (CBD) in different countries can be a complex task due to the varying laws and regulations. This article will delve into the legal framework surrounding CBD in Chile.

Chilean Drug Law

Chilean drug law is primarily governed by Law 20.000, which deals with trafficking and the illegal use of narcotics and psychotropic substances. However, the law does not explicitly address CBD. Instead, it refers to cannabis and its derivatives, which could include CBD. This ambiguity in the law can lead to confusion about the legality of CBD in Chile.

Medical Use of Cannabis and CBD

In 2015, Chile legalized the use of medical marijuana, becoming the first country in Latin America to do so. This move was followed by the approval of a framework for a medical cannabis program, which allows the cultivation, import, and sale of cannabis for medical use. However, it is important to note that this program is strictly regulated and requires a prescription from a licensed medical professional.

As for CBD, it is considered a cannabis derivative and is therefore included in the medical cannabis program. This means that CBD is legal for medical use, but it must be prescribed by a healthcare professional.

The Sale and Purchase of CBD

As per the current legal framework, the sale and purchase of CBD products are allowed in Chile, but they are heavily regulated. CBD products can only be sold in pharmacies and only to individuals who have a valid prescription. It is illegal to sell CBD products outside of this context.

The Cultivation of Hemp and CBD

Under the Chilean law, the cultivation of hemp is legal. However, this is subject to certain restrictions. For instance, individuals must obtain a permit from the Chilean Agriculture Service. Additionally, the hemp must contain less than 1% of THC, the psychoactive compound found in cannabis.

Regarding CBD, since it is considered a cannabis derivative, its cultivation is also legal but is subject to the same restrictions as medical cannabis. This means that individuals cannot grow CBD-rich cannabis plants without a permit.

To simplify, CBD is legal in Chile under certain conditions. It is included in the medical cannabis program, meaning it can be prescribed by a healthcare professional for medical use. CBD products can be sold in pharmacies to individuals with a valid prescription. The cultivation of hemp and CBD is legal, but it requires a permit and must adhere to certain restrictions. However, due to the ambiguity in the law, the legal status of CBD in Chile can be subject to different interpretations.
